Insurance Lawyers: Homeowners Claim Denials
After a fire destroyed her modest home, a woman had to move her family into Section 8, low-income rental housing. She had insurance, but Allstate refused to pay her claim. In the homeowners claim denial, they falsely accused her of arson.
The woman was diabetic, partially blind and poor — an easy target for a giant insurance company. They took unfair advantage of her.
A Costly Misjudgment
The insurance company made many mistakes in this case, but perhaps the largest was their misjudgment of the woman's character. They didn't expect her to fight and they certainly didn't expect her to call us.
After examining the case, we filed an insurance bad faith lawsuit and settled for an amount that far exceeded the limits of her insurance policy. The amount of the settlement must remain confidential. However, the woman now lives in a beautiful architect-designed home atop a hill in a prestigious neighborhood. She won't have to worry about her own financial needs or her children's college education.
Effective Help in Complex Claims
At Pillsbury & Levinson, LLP, our attorneys take pride in helping policyholders facing enormous odds receive the insurance coverage they are entitled to receive. We are especially well known and respected for our work in complex homeowners claim disputes.
We turned around a case in which the insurance company was suing the policyholder. We cleared up that dispute, established that the policyholder had replacement cost insurance for her home and its contents, and won a settlement so substantial that the insurance company president literally screamed when he signed the check.
Recently, we represented a homeowner who was sued by his down hill neighbor for a landslide that occurred after a torrential winter rains. His insurance company refused to stabilize the hillside, even though the landslide continued to move and threaten the down hill neighbor. We filed an action against the insurance company establishing the right to bad faith and punitive damages for the insurance company's conduct in refusing to stabilize the hill or hire appropriate counsel to defend the homeowners.
Have you received a homeowners claim denial for a valid insurance claim? Did your insurance company unreasonably delay payment, undervalue your claim or accuse you of fraud? Did they fail in their duty to defend you from a lawsuit after someone was injured on your property?
